R4 Refusal: Genuineness of Relationship
A sponsorship refusal where the officer found the relationship was entered primarily for immigration purposes, or is not genuine.
What R4 means
R4 refers to section 4 of the Regulations. It provides that a person is not considered a spouse, common-law partner, or conjugal partner if the relationship was entered into primarily to acquire a status or privilege under the Act, or is not genuine.
An R4 refusal reflects the officer's assessment of the relationship's genuineness based on the evidence and, sometimes, an interview.
Why officers cite R4
- Limited documented history of the relationship
- Inconsistencies between the couple's answers at interview
- A short courtship before marriage or sponsorship
- Significant differences the officer views as unexplained
- Sparse evidence of ongoing communication or shared life
What it does not mean
- It is not a criminal finding
- It does not necessarily prevent a future, better-documented application
General options after a R4 refusal
Appeal to the IAD. Many family-class sponsorship refusals can be appealed to the Immigration Appeal Division, where new evidence can be presented, subject to eligibility and deadlines.
Reapply with stronger evidence. A new application with fuller documentation of the relationship is often possible.
